Terms of service

I. General Terms

  • Please write in a clear and nice manner, no aggression will be tolerated.

  • Please explain in detail what you are looking for, I can't read minds so if you don't I have no way to know what you want.

  • References aren't required but they do make the process significantly easier.

    • Please provide neat references with explains of why you like them.

II. Payment

  • I only accept payments upfront paid in USD through paypal, CashApp, or Venmo.

  • I charge upfront based on an estimated time that I think your commission will take, however I do also clock my hours. At the end if turns out your commission will take more or less time than expected you will be updated.

  • If your commission takes less time than expected you will be refunded for the extra hours that you paid for.

III. Process

  • The time for your commission normally takes is a month, however I reserve the right to take up to 3 months depending on many factors such as;

    • Health

    • How many commissions I am working on at that time

    • Complexity

    • Other unforeseen emergencies

  • If any of the things stated above occur you will be notified right away.

IV. Sizing

  • I will do everything I can to make my customers happy. However after the Sketching phase is finished, only small changes are allowed to be made. Such as small colouring/marking mistakes.

  • Any large changes will come with an added fee of $25 USD.

    • Examples of this are an outfit change, outfit addition or subtraction, detail redesign on a major scale, background change or anything that makes me have to redraw it completely.

  • Make sure to be clear in your order what you aim for.

V. Copyright/Usage Policy

  • I, the artist,

    • hold every right to the produced drawing, not the commissioner, until the Copyright Transfer Fee of $75 USD has been paid.

    • reserve the right to use the artwork I create to promote myself, on any social media platform I use, unless explicitly asked otherwise.

  • As the commissioner you are allowed to:

    • Use the copyrighted artwork for personal use, such as a tattoo, unless otherwise agreed upon.

    • Print the art, and claim the right of their character(s) the art contains, but not the drawing itself.

    • Use the art to promote themselves with the Commercial Fees paid and proper credit given to the artist.

      • If you want to use the artwork for Commercial Use you need to discuss how it will be used to me, as every case is unique.

  • If you infringe on the copyright in any way, every right you had to the drawing will be retracted and a copyright strike will be issued.

VI. Commercial Use

  • As a general rule of thumb you will have to pay a fee of 50% of the original price of the commission, plus a percentage of sales earned.

  • My Credit Prompt

    • Thank you to Cor over at Wares by Fiend for the art! You can find them on both TikTok and Instagram by searching FiendAntics. All of their information, including pricing and contact info can be found here on their website (waresbyfiend.com) under the Art Commissions section.

  • Crediting Me

    • If you don't wish to use the blurb you are still required to credit me. That credit must include the following elements; My name, the name of my business (Wares by Fiend), where I can be found on TikTok and Instagram, and the link to my website.

  • Social Media

    • If you are using their promote feature, or their ad feature, you are required to include a short blurb in the video/post containing where I can be found and what I do in a positive light.

    • You are required to have credit to me in the description of your video/post with my account tagged.

VI. Refunds

  • If money has not been sent yet the commissioner has the right to cancel the commission.

  • If I work less than what you were charged I will refund you the remaining amount.

  • Nonrefundable Agreement & Chargebacks

    • All commissions from me are nonrefundable, if you file a chargeback against me, your right to everything I have ever made for you will be retracted and I have the right to sell the artwork to new buyers.

    • You will be blacklisted from my services and your name will be publicly posted to warn others.

    • I have every right to file a complaint as you have broken our contract and committed theft.
